A Federal High Court, Abuja, Friday, dismissed an application filed by the police seeking a stay of execution of an order allowing Senator  to travel to the United states of America (USA) for medical check-up.

The trial Judge, Justice Inyang Ekwo, dismissed the application of the police for lacking in merit.

Ekwo had, on May 6, granted leave to Adeleke to travel to the USA on May 7 and to return on June 9, 2019, to enable him undergo an urgent medical check-up.

He equally ordered Adeleke to honour an invitation of the police on May 6 before leaving for the US, having restrained the police from arresting him.

Adeleke was however arrested on the day he went to honour the police invitation and was consequently arraigned the next day before a magistrate court in Mpape area of Abuja on a five-count charge bordering on alleged false statement and forgery.

Adeleke, who was the candidate of the People’s Democratic Party (PDP) in the 2018 governorship election in Osun State, was however granted bail and travelled abroad for the check-up.

To prevent the Senator from the medical trip, the police approached the court with an application for stay of execution of the ruling, pending the hearing and determination of the appeal at the Court of Appeal.

The police also wanted the court to restrain Adeleke from acting upon enforcing the ruling, until the appeal is determined.

In the appeal, hinged on five grounds, the police said the statutory duties of the police would be disturbed if the ruling of the court was executed, while the appeal is pending, since Adeleke, who knew he was about to be charged for forgery and false declaration would have escaped from the country.

Southwest PDP condemns Adeleke’s arrest

The Southwest chapter of the People’s Democratic Party (PDP) has condemns the arrest and arraignment of the Governor-elect of Osun State, Ademola Adeleke by the Nigerian Police Force, saying that the action was meant to harass and intimidate him.

Adeleke, who was the candidate of the PDP in the 2018 governorship election in Osun State, was arrested by the police on Monday.

Force spokesman, Frank Mba, had explained that Adeleke was picked up for a criminal offence.

However, Adeleke was on Tuesday, granted bail by a Magistrate Court sitting in Mpape in the sum of N2million and a surety who must be resident within Mpape. But in a statement by the National Vice Chairman (South-west) of the party, Eddy Olafeso, a copy of which was sent to BusinessDay, the party expressed dismay that the Nigeria Police Force could arrest and arraign Adeleke on an issue which had already been addressed by the court. The party, however, stated that no amount of intimidation and harassment could stop it and Adeleke from further pursuing the legal actions to retrieve its allegedly stolen mandate in Osun State.

The PDP further warned that there would be dire consequences if any harm befalls Adeleke now or in the coming days.

The opposition party further reminded the Nigeria Police that it was a constitutionally recognised institution of the state, stressing that it should not allow itself to be used by the ruling All Progressives Congress (APC).

Defense lawyer wants court to dismiss case against Isiaka Adeleke

The defence team of Isiaka Adeleke has on Tuesday morning asked the magistrate court to discontinue the case against their client since there are subsisting court rulings barring the police from arresting and detaining Adeleke over the matter.

The Nigerian Police Force had arraigned Isiaka Adeleke, the gubernatorial candidate of the People’s Democratic Party in Osun State, at a magistrate court after he was arrested on Monday.

The force through its spokeman, Frank Mba, said Adeleke will be tried in connection with a criminal investigation.

“Senator Adeleke is currently in police custody. He was taken into custody in the evening of 6th, May, 2019, in connection with ongoing criminal investigations touching on his person.

“Meanwhile, in the best tradition of natural justice and fair hearing, he has already been served with the relevant charge sheet containing his alleged offences in the presence of his attorneys,” Mba said.
